FINALLY: Trump Admin Gets Huge Win Over Palestinian Activist Mahmoud Khalil

The Trump administration secured a significant legal victory on Thursday. The 3rd Circuit Court of Appeals determined a federal district judge in New Jersey lacked the authority to order the release of Mahmoud Khalil, an Algerian national facing deportation.

Khalil’s green card was revoked after he failed to disclose extremist views and associations. His case became protracted when Judge Michael Farbiarz, appointed by President Biden, intervened and ordered his release in June.

The appeals court overturned this ruling in a 2-1 decision. The panel clarified that Farbiarz never had proper jurisdiction to hear Khalil’s habeas corpus petition in the first place.

Judges Thomas Hardiman and Stephanos Bibas wrote that immigration law requires such challenges to be heard within the dedicated immigration court system. This prevents individuals from bypassing the established legal process.

The ruling nullifies the prior release order, allowing Immigration and Customs Enforcement to potentially re-detain Khalil. His legal team has indicated plans to appeal the decision.

The case highlights concerns over judicial overreach, where a district judge was able to stall a straightforward deportation for months without valid jurisdiction. Critics view such actions as an inappropriate use of judicial power for political ends.

To the public, this prolonged episode appears less as a function of justice and more as a form of judicial obstruction, undermining confidence in the legal process.
